EXOPS AI L.L.C. grants you a non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms.

Access begins when your purchase is completed. Links to Custom GPTs are delivered via digital download in your purchase receipt. Purchase grants lifetime use and all future updates.

5. Dependency on OpenAI Platform

Third-Party API: All Custom GPTs rely on the OpenAI GPT-4 API. EXOPS AI L.L.C. is not responsible for downtime, API changes, pricing adjustments, or policy updates enacted by OpenAI.

Service Interruptions: EXOPS AI L.L.C. disclaims liability for interruptions due to maintenance, API quotas, or technical failures on OpenAI’s side.

6. Intellectual Property

Ownership: EXOPS AI L.L.C. retains all rights, title, and interest in the Services, including system prompts, configurations, and flow designs.

User Inputs: You retain ownership of any input data you provide. By submitting inputs, you grant EXOPS AI L.L.C. a limited license to process them solely to deliver the Services.

Session inputs are processed solely to deliver Services and are not retained by EXOPS AI L.L.C. beyond each session.

Additionally, EXOPS AI has disabled OpenAI’s optional data sharing feature for model training (“Improve model for everyone”). Therefore, your session inputs are not used to improve or retrain OpenAI’s models.

6.1 User Comments & Community Content

Some areas of our site may allow you to post comments or feedback. You agree that:

• You own or have rights to any content you post.

• Your comments will not be defamatory, infringing, or unlawful.

• EXOPS AI L.L.C. may monitor, edit, or remove any user-generated content at our discretion.

8. Payment & Refund Policy

One-Time Fee: Lifetime access and updates are unlocked by a single payment.

Refunds: Full refunds available if requested within 24 hours of purchase, provided reasonable usage limits have not been exceeded. Contact support at info@exopsai.io to initiate.

9. Limitation of Liability

To the maximum extent permitted by law, EXOPS AI L.L.C. and its affiliates shall not be liable for:

• Indirect or Consequential Damages: Lost profits, data, or goodwill.

• Aggregate Liability: Not to exceed the total fees paid by you for the specific Service in the 12 months prior to the claim.

You agree to indemnify, defend, and hold harmless EXOPS AI L.L.C. and its officers, employees, and agents from any claims, damages, or losses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, Harris County, USA, without regard to conflict-of-law provisions. Any disputes will be settled in the courts of Harris County, Texas.
